General Terms & Conditions WanderSiam Co. Ltd.
The conditions below apply to all travel arrangements and services offered by WanderSiam Co. Ltd. By making a booking, the traveler enters into a binding agreement and automatically agrees to these terms and conditions.
- Payment
1.1 Deposit
Upon entering into the agreement, a deposit of 25% of the land arrangement is required, increased by the costs of any non-refundable components of the trip (such as domestic flights, train, bus and boat tickets, and certain hotel reservations). The deposit must be paid within 7 days, unless otherwise agreed. For specific services or tickets, different payment conditions may apply.
1.2 Balance Payment
The remaining balance of the total travel price must be paid no later than six weeks prior to arrival. For bookings made within six weeks before departure, the full travel amount must be paid immediately at the time of booking. Failure to make timely payment may result in cancellation of the trip, in which case the cancellation conditions will apply.
1.3 Bank and Transaction Fees
Payments must be transferred to our bank account in Thailand. Alternatively, payment via PayPal is possible; a surcharge of 5% applies. All bank and transaction fees are entirely at the expense of the traveler.
- Cancellations and Amendments by the Traveler
Cancellations
Any cancellation must be submitted in writing by email. The following charges apply:
2.1 Non-Refundable Components of the Trip
Airline tickets, train tickets, bus tickets and ferry tickets are booked and paid in advance and are non-refundable. Therefore, no refund is possible in case of cancellation, regardless of the time or reason for cancellation. In certain cases, this also applies to specific hotel stays that require partial or full prepayment at the time of booking.
2.2 Other Cancellation Charges of the Booking, in addition to the costs mentioned under clause 2.1:
2.2.1
In case of cancellation more than 42 days prior to the scheduled arrival date, a fee of 25% of the remaining travel amount will be charged.
2.2.2
In case of cancellation from 42 days up to 28 days prior to the scheduled arrival date, a fee of 50% of the remaining travel amount will be charged.
2.2.3
In case of cancellation from 28 days up to 7 days prior to the scheduled arrival date, a fee of 75% of the remaining travel amount will be charged.
2.2.4
In case of cancellation from 7 days prior to the scheduled arrival date, a fee of 100% of the remaining travel amount will be charged.
2.3 If the calculated cancellation charges are lower than the deposit already paid, the deposit shall be considered the cancellation fee.
2.4 Refunds will be transferred from our Thai bank account to the customer’s bank account. Any bank or transaction fees charged in this process are at the customer’s expense.
2.5 Partial Cancellations
If one or more travelers within a group cancel, this constitutes a partial cancellation. The costs for the person or persons canceling will be charged accordingly. For the remaining participants, the travel price will be adjusted, as the accommodation occupancy has changed and/or fixed costs (for example, private transfers) will be divided among fewer participants. If an amendment is not possible or not accepted, the entire booking will be canceled and the standard cancellation conditions will apply.
2.6 Amendments by the Traveler
An amendment to a booking is only possible prior to departure and is subject to availability. Any amendment must be submitted in writing by email. For amendments, we charge THB 500 per booking per amendment, plus any additional costs charged by suppliers. Changing a departure date or canceling a segment is considered a cancellation and falls under the cancellation conditions. For airline tickets, the rules and conditions of the respective airline always apply.
- Force Majeure
3.1 Program Adjustments
Certain factors may affect the execution of the trip, such as weather conditions, schedule changes, natural disasters or political unrest. If circumstances require, WanderSiam reserves the right to make changes to routes, daily schedules, accommodations, transportation or excursions, either prior to departure or during the trip. In such cases, WanderSiam will make every reasonable effort to maintain the quality and character of the trip as much as possible.
3.2 Liability in Case of Force Majeure
WanderSiam and its local partners are not responsible for losses, costs, material or immaterial damage resulting from delays or changes to the travel schedule, accommodation overbooking, failure of third parties not acting as auxiliaries of WanderSiam, illness, natural disasters, strikes, emergencies, terrorist events, government measures, civil unrest, acts of war, customs regulations, epidemics, criminal activities, or any other cause beyond its control. Such losses or costs must be borne and paid by the traveler.
3.3 Liability for Delays
Ferry and boat services may occasionally experience delays or, in exceptional cases, be canceled due to severe weather conditions. A delayed flight or (night) train may also result in missed connections. The tour operator cannot be held liable for missed connections, hotel nights or any additional costs arising from such situations.
- Liability and Indemnification
4.1 Liability
WanderSiam acts as an intermediary between travelers and suppliers such as hotels and local partners. We accept no liability for damage, loss, illness, injury or costs arising from participation in our trips or services.
4.2 Indemnification
The customer indemnifies WanderSiam against all damage to property or personal injury (including death), illness, loss, accidents, costs, delays or other irregularities caused by intentional or negligent acts of the traveler, representatives or contracted third parties, or by failure to comply with regulations by the customer, representatives or contracted third parties. WanderSiam acts solely as an intermediary between airlines, hotels, local partners and other service providers. WanderSiam cannot be held liable if incorrect information regarding excursions or programs is provided by third parties.
- Travel Documents and Health
5.1 Travel Documents
The traveler is responsible for ensuring possession of valid travel documents (passport, visas). In most cases, the passport must be valid for at least six months upon arrival. Any issues arising from missing or invalid documents are entirely at the traveler’s risk.
5.2 Arrival Card Thailand
All foreign tourists traveling to Thailand must possess an electronic/digital arrival card (TDAC). The TDAC must be completed via https://tdac.immigration.go.th/arrival-card/#/home
This can be done from three days prior to arrival in Thailand. Travelers are responsible for ensuring they have a valid TDAC before departure. Although not mandatory, we recommend printing the arrival card and bringing it along to Thailand.
5.3 Health
Travelers are responsible for checking which vaccinations or health measures are required. We recommend seeking advice in advance from a general practitioner or specialized medical institution. Travelers should bring sufficient medication, accompanied by English-language prescriptions or statements if required. Travelers should be aware that certain medications require an international declaration to be carried legally, particularly medicines that fall under opium or narcotics legislation. Consult a physician or specialist in a timely manner to determine whether this applies.
- Travel and Cancellation Insurance
6.1 Insurance Recommendation
We strongly advise every traveler to take out comprehensive travel insurance that covers death, injury, illness, theft, damage and other unforeseen circumstances. Neither WanderSiam nor its employees, agents or partners can be held liable for loss, damage, theft of property or medical issues. Any costs resulting from (uninsured) incidents are entirely at the traveler’s expense.
- Accommodation
7.1 Description and Photos
Accommodations are described as accurately as possible in our quotations, travel proposals and/or on our website. Photos of room interiors shown on our website and in travel proposals are intended to give a general impression only. Most hotels offer different room types that may vary in price, size, layout, colors and view. Our travel proposals may include photos of various room types for reference purposes only. The room type booked for the traveler may differ from the images shown in the proposal. WanderSiam relies on information provided by third parties and cannot be held responsible for incorrect accommodation descriptions.
7.2 Check-in and Check-out
Check-in is usually between 14:00 and 15:00, and check-out generally between 10:00 and 12:00. Early check-in or late check-out can be requested when arranging the trip and may involve additional charges. Luggage can often be stored at reception; however, this is at the traveler’s own risk and without liability for loss or damage.
7.3 Room and Bed Configuration
If traveling with two persons, accommodation will be in a double room unless otherwise stated. For triple occupancy, a roll-away bed will be added. In some cases, a sofa bed or mattress on the floor may be provided instead of a standard bed. Roll-away beds and sofa beds/mattresses are generally smaller than standard beds and may reduce available room space.
7.4 Other Preferences
If the traveler has specific preferences, such as room location or bed type (one double bed or two single beds), we will forward these requests to the accommodation. Such preferences can never be guaranteed and are subject entirely to availability on the day of arrival. Hotels will always make reasonable efforts to accommodate requests where possible.
7.5 Traveler Liability
The traveler must use and maintain the accommodation with due care and in accordance with its intended purpose. The traveler is liable for loss of or damage to the accommodation and/or its inventory, unless it can be demonstrated that such loss or damage cannot be attributed to the traveler. If the traveler, or persons for whom the traveler is responsible, behaves in a manner that causes damage, fails to comply with house rules of the accommodation provider or carrier, disturbs other guests, or causes nuisance, we reserve the right, as do the accommodation provider or carrier, to deny access to or remove the traveler from the accommodation or means of transport. In such cases, we also reserve the right to terminate the travel agreement for compelling reasons. We cannot be held liable for the actions or omissions of other guests.
- Airline Tickets
8.1 Airline Ticket Prices
Prices for flights included in a travel proposal are always subject to availability and possible price changes until the tickets are actually issued.
If the ticket price at the time of booking is higher than quoted, the traveler will be informed in advance and the tickets will only be issued after approval.
8.2 Cancellation and Changes of Airline Tickets
Once tickets have been issued, cancellation is usually not possible and 100% cancellation charges apply, regardless of the reason for cancellation. Date changes are generally not permitted. If, in exceptional cases, a date change is allowed, this can only be done against payment of (often substantial) change fees plus any fare difference, in accordance with the conditions of the respective airline.
- Privacy
9.1 Use of Personal Data
Personal data is treated as strictly confidential and used solely for the execution of the booked services.
10. Taxes and Surcharges
10.1 Taxes Included
Unless stated otherwise, taxes are included in the travel price.
10.2 Local Fees
Local fees, national park fees and possible airport taxes may be payable locally. If applicable, this will always be clearly stated in advance.
10.3 Government-Imposed Changes
In the event of tax changes imposed by the government, WanderSiam reserves the right to adjust prices accordingly.
11. Other Provisions
11.1 Conduct and Cultural Differences
Traveling abroad involves exposure to different people, customs, cultures and cuisines. This is an important and attractive aspect of travel, but also something travelers should take into account when setting expectations. The most important general guideline is that travelers should always be aware that they are guests in another country or region, often with an ancient culture of which people are proud. Unforeseen situations may also arise during travel; travelers are therefore expected to show a degree of flexibility and adaptability. Awareness of cultural differences and local customs is essential, and respect and flexibility are key.
11.2 Responsible Tourism
When designing our trips, we take people, environment, nature and culture into consideration, ensuring that travel experiences are not only special for the traveler but also sustainable for future generations. Whether enjoying unspoiled nature, experiencing local culture, meeting new people or tasting local cuisine, our trips aim to contribute to better destinations and meaningful experiences. In doing so, we support sustainable development for both travelers and local communities.
11.3 Complaints
Any complaints arising during the trip must be reported immediately to the relevant service provider and to us, so that we have the opportunity to provide an appropriate solution as quickly as possible.
Final Provision
By booking a trip with WanderSiam Co. Ltd., the traveler confirms acceptance of the above terms and conditions.
